Article 1
For the purpose of conducting advanced adult study and continuing education through audio/visual media, the Act is formulated in accordance with Item 2, Article 28 of the University Act. Those not included in this act will be applicable to other regulations.
Article 2
The competent authorities of the Act: the Ministry of Education in Central Government; city government in special municipalities.
Article 3
The Open University is divided into national and special municipal. The National Open University shall be established by the Ministry of Education upon review of national conditions; special municipal open university shall be established with the approval of the Ministry of Education after it has been initiated by special municipal governments.
Article 4
The Open University utilizes diversified mass media in the implementation of teaching assisted by face-to-face, writing and other appropriate teaching methods to support course instruction.
Article 5
Students in the Open University shall be divided as regular full-time students and seminarian students, both of them are not allowed to apply for deferring or postponing enlistment of military service.
Article 6
Full-time students shall have student status and shall be 20 years old or above. They should be graduates either from a senior high school, or equivalent school, or have the equivalent educational level. They shall be enrolled through open recruitment procedures.
The number of full-time students for each academic year shall be reported to and approved by the Ministry of Education.
The seminarian students who have completed 40 credits and meet the requirements shall be considered to have the equivalent educational level of full-time students.
Article 7
The education background of elective students shall not be restricted, anyone who is over 18 years old shall be eligible to register and study.
Article 8
The Open University shall establish different departments and graduate schools, if necessary.
The establishment, change or closure of the above-mentioned departments or graduate schools shall be approved by the Ministry of Education.
The Open University may establish a Supplementary Junior College with the approval of the Ministry of Education.
Article 9
The Open University adopts a credit system.
The total number of credits a full-time student shall complete before graduation must not be less than the minimum credits completed by the students at ordinary universities. The credits shall be approved by the Ministry of Education.
Article 10
The name and the credit number of compulsory subjects at the Open University shall be decided by the Open University and reported to competent authorities for approval as well as to the Ministry of Education for reference.
Article 11
In conducting continuing education, the Open University may open practical courses for people on life skills and specialized education.
Article 12
No make-up examinations shall be given to Open University students for failed subjects during the semester.
Student achievement evaluation regulations shall be set by the Open University and approved by the competent authorities.
Article 13
After completing all required credits and passing all the examinations, full-time students shall be given certificate of graduation by the Open University and awarded a degree according to the Degree Conferral Law. Those who have not achieved all the required credits will be awarded a credit certificate of successful completion for the course.
Article 14
A credit certificate shall be presented to seminarian students for course complletion and for passing their examinations. When these students are admitted through the open recruitment as full-time students, they are entitled to claim exemptions for the courses studied.
Article 15
The Open University shall appoint a president for the overall management of the university. This appointment shall meet the requirements stipulated in Article 6 of the University Act.
Article 16
The Open University shall establish the following divisions to manage related works:
1. The Department of Academic Affairs: registration, curricular affairs, writing and editing of teaching materials and data processing;
2. The Department of Instructional Media: teaching designs and the planning, development, production and the transmission of teaching media;
3. The Department of Student Affairs: regional study centers' communications, coordination and student counseling services.
4. The Department of Research and Development: teaching and learning improvement, production of teaching and learning programs, and research and development of teaching materials.
5. The Department of General Affairs: planning, public relations, publishing teaching materials, circulation, general affairs, documents and anything that does not belong to other divisions.
The above-mentioned divisions may be subdivided further into sections.
For the needs of teaching, research and promotion, the Open University shall establish libraries, various research centers, computer centers and other units; the measures shall be drawn up by the university and approved by the competent authorities.
Article 17
The Open University shall establish a personnel office, and appoint a director and several assistants, to implement personnel management.
Article 18
The Open University shall establish an accounting office, appoint a director and several assistants as well as to implement the budget, accounting and statistic matters.
Article 19
The head of Department of Academic Affairs, as well as the department head of each department, shall be appointed by the president of the university along with full-time professors. The department head of Department of General Affairs shall be appointed by the president.
Article 20
The Open University shall the establish academic affairs council as the highest decision-making council. The matters of the academic affairs meetings shall meet the requirements stipulated in the University Act.
Article 21
The ranking and hiring of teachers in the Open University shall meet the requirements stipulated in the University Act and its related regulations.
Article 22
The Open University shall establish regional study centers, appoint a full-time or part-time director for each center by the president, who shall be responsible for managing the center; and a certain number of employees shall be appointed for each center to help implement related affairs.
At the regional study centers, in addition to hiring full-time or part-time teachers for teaching, the centers may appoint a certain number of full-time or part-time homeroom teachers, who are responsible for students’ academic guidance and life counseling.
Article 23
If necessary, a regional study center of the Open University shall install classrooms, audio-visual rooms, libraries, a guidance room, laboratory or practice equipment along with other necessary teaching facilities.
Public schools shall provide the Open University with necessary space and facilities under the condition that the provisions do not hinder their regular teaching, research and routine operations.
Article 24
The Organic Regulations of the Open University shall be formulated by the universities and approved by Ministry of Education.
Article 25
The Enforcement Rules of the Act shall be formulated by the Ministry of Education.
Article 26
The Act shall be effective as of the date of its promulgation.
