中核釋外國學生來臺就學辦法第十一條第三項所定「外國學生經入學學校以操行、學業成績不及格或因犯刑事案件經判刑確定致遭退學者，不得再依本辦法申請入學。」其中學業成績係指獲取學位條件之在校學習及各項考試之學業考核；以博士資格考核係學校就博士生是否得成為博士候選人之資格考核，從而博士資格考核未通過者，非該項規定所稱學業成績不及格。
